These Terms of Use and Online Ordering Terms apply to your use of www.musashi.ie, any related Musashi websites, and any Musashi mobile application or online ordering platform made available by us from time to time.

Please read these Terms carefully before using our website, creating an account, joining our loyalty programme, or placing an order. By using our website, app, or online ordering service, you agree to be bound by these Terms, our Privacy Policy, our Cookie Policy, and any additional terms displayed at checkout or in connection with a promotion.

If you do not agree to these Terms, please stop using our website, app, and online ordering services.
 

1. About Us

The website and online ordering services are operated by Musashi Co. Limited, trading as Musashi.

In these Terms, “Musashi”, “we”, “us” and “our” refer to Musashi Co. Limited and, where relevant, the Musashi restaurant or branch fulfilling your order.

“You” and “your” refer to the person using our website, app, account system, loyalty programme, or online ordering service.
 

2. Website and App Use

Our website and app are made available for your personal use. You may browse our menu, place orders, manage your account, access promotions, and participate in our loyalty programme where available.

Access to our website and app may be suspended, restricted, or changed from time to time for maintenance, updates, technical issues, security reasons, operational reasons, or matters outside our reasonable control.

We aim to keep the information on our website accurate and up to date. Menu items, prices, branch availability, opening hours, delivery areas, promotions, and other content may change from time to time.
 

3. Your Eligibility

By using our website or placing an order, you confirm that:

  1. you are legally capable of entering into a binding contract;

  2. you are at least 18 years old;

  3. the information you provide to us is accurate and complete;

  4. you are using the website, app, and ordering services for personal use or ordinary business catering use.

Where age restricted items are offered, you may be asked to provide valid proof of age on collection or delivery. We reserve the right to refuse the sale, collection, or delivery of age restricted items where proof of age is requested and satisfactory proof is not provided.
 

4. Accounts

You may place an order as a guest where guest checkout is available. You may also create a Musashi account to save your details, view order history, access loyalty points, and receive account related communications.

You are responsible for keeping your login details secure. Any activity carried out through your account will be treated as activity authorised by you unless you notify us of unauthorised access.

You agree to contact us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where we reasonably believe there has been misuse, fraud, attempted fraud, abuse of promotions, breach of these Terms, or activity that may cause loss or risk to Musashi, our customers, our staff, or our systems.
 

5. Food, Menu and Allergen Information

Our food is prepared in active restaurant kitchens where allergens are handled. Our products may contain, or may come into contact with, allergens including cereals containing gluten, crustaceans, eggs, fish, peanuts, soybeans, milk, nuts, celery, mustard, sesame, sulphites, lupin, molluscs, and other ingredients.

We take care when preparing food and providing allergen information. Due to the nature of restaurant kitchens, shared preparation areas, shared utensils, shared fryers, shared storage, supplier changes, and ingredient substitutions, we cannot guarantee that any item will be completely free from traces of allergens.

If you or anyone you are ordering for has an allergy, intolerance, dietary requirement, or food safety concern, please contact the relevant Musashi branch directly before placing your order. Please do not rely only on the order notes box for allergy information. Order notes may be used for general preferences, but allergy and intolerance concerns should be confirmed directly with the branch before ordering.

Images of menu items are for illustration only. The item you receive may vary in appearance, portion arrangement, packaging, garnish, or presentation.

Some items may be unavailable at certain branches or at certain times. We may offer a suitable substitute where an item is unavailable, subject to your agreement where required.
 

6. Placing an Order

To place an order, you must select your preferred branch, choose your menu items, provide the required collection or delivery details, review your order, and submit payment where online payment is required.

Before submitting your order, please check all details carefully, including:

  1. branch selection;

  2. delivery or collection choice;

  3. delivery address;

  4. contact phone number;

  5. order date and time;

  6. menu items and quantities;

  7. allergen or dietary concerns already discussed with the branch;

  8. voucher or promotion code;

  9. total price and charges.

Once your order is submitted, we will send an order confirmation or acknowledgement by email, screen message, SMS, app notification, or another available method.

An order confirmation means that your order has been received by our system. Your order remains subject to branch acceptance, payment authorisation, item availability, delivery area availability, capacity, and operational conditions.
 

7. Order Acceptance and Contract Formation

A contract for your order is formed when the relevant Musashi branch accepts your order and begins processing it.

We may reject or cancel an order before or after initial confirmation where:

  1. the selected branch is too busy;

  2. the selected branch is closed or unavailable;

  3. an item is unavailable;

  4. the price or menu information contains an obvious error;

  5. the delivery address is outside the available delivery area;

  6. payment is declined, reversed, flagged, or unavailable;

  7. the order appears fraudulent or abusive;

  8. age restricted requirements are not satisfied;

  9. weather, traffic, staffing, technical issues, safety concerns, or other operational issues affect fulfilment.

If we cancel an order that has already been paid for, we will arrange a refund using the original payment method where possible.
 

8. Prices, Charges and Payment

Prices are displayed on our website, app, or online ordering system. Prices include VAT where applicable, unless stated otherwise.

Delivery charges, service charges, small order charges, bag charges, platform charges, tips, or other applicable charges may be added at checkout and shown before you place your order.

Prices may vary between branches, online channels, in-store menus, delivery platforms, and promotional campaigns. A price shown for one branch, platform, or promotion may not apply to another branch, platform, or promotion.

We take care to ensure that prices are correct. Where an obvious pricing error occurs, we may contact you to confirm the correct price or cancel the affected item or order. Where payment has already been taken and the order is cancelled due to a pricing error, we will refund the relevant amount.

Payment may be made by credit card, debit card, cash where available, gift card, voucher, loyalty points, or any other payment method displayed at checkout.

Online payments are processed by third party payment providers. By placing an online order, you authorise us and our payment providers to process your payment and carry out payment security checks.

We may decline to process an order where payment is declined, incomplete, disputed, reversed, flagged for security reasons, or otherwise unavailable.
 

9. Collection

Where collection is selected, your order should be collected from the branch shown at checkout.

Collection times are estimates. We aim to prepare your order for the selected collection time, but preparation may be affected by order volume, staffing, kitchen capacity, item availability, technical issues, and other operational factors.

Please arrive at the branch at or near the estimated collection time. Food quality may be affected if an order is collected late.

We may ask for your order number, name, phone number, email address, or other reasonable proof that the order belongs to you.
 

10. Delivery

Delivery is available only from selected branches and only to selected areas. Delivery availability, delivery fees, minimum order values, and estimated times may vary by branch and address.

Delivery times are estimates. We aim to deliver within the estimated time shown at checkout or in your confirmation message. Weather, traffic, road conditions, driver availability, order volume, technical issues, and other circumstances may affect delivery times.

Where you choose delivery, you agree to be available at the delivery address and contactable using the phone number provided. If our driver or branch cannot contact you, the order may be delayed, returned to the branch, or handled in a reasonable way according to the circumstances.

If you provide an incorrect address, incomplete address, incorrect phone number, inaccessible location, or delivery instructions that prevent successful delivery, we may charge you for the order and any delivery fee.

Some branches may offer collection only. Some items may be collection only. Delivery availability may change without advance notice.
 

11. Changing or Cancelling Your Order

Freshly prepared food orders are processed quickly. If you wish to change or cancel an order, please telephone the relevant branch as soon as possible.

For same day orders, changes or cancellations may be accepted only where the branch has not started preparing the food and can reasonably process the request.

For advance orders, cancellation may be accepted up to 24 hours before the scheduled collection or delivery time, unless a different cancellation period is displayed at the time of order or agreed with the branch.

Once food preparation has started, we may be unable to cancel, change, or refund the order. Where an order is cancelled after food preparation has started, we may charge the full order price.

This cancellation policy applies to freshly prepared food and catering orders. Your statutory rights remain unaffected.
 

12. Refunds, Missing Items and Order Issues

If something is wrong with your order, please contact the relevant branch as soon as possible and provide your order number, contact details, and a clear description of the issue.

For missing items, incorrect items, damaged packaging, quality concerns, delivery issues, or food safety concerns, we may request photos, order details, delivery details, and any other information reasonably needed to investigate.

Depending on the circumstances, we may offer one or more of the following:

  1. replacement item;

  2. corrected order;

  3. partial refund;

  4. full refund;

  5. voucher or goodwill credit;

  6. other reasonable solution.

Refunds are usually made to the original payment method where possible. Processing times may depend on your bank, card issuer, or payment provider.

We may decline a refund where the issue results from incorrect customer information, late collection, failure to answer delivery contact attempts, misuse of the service, repeated unreasonable claims, or circumstances outside our reasonable control.

Food safety and allergen complaints are treated seriously. Please contact the branch immediately if you believe your order raises a food safety issue.
 

13. Promotions, Vouchers and Discount Codes

We may offer promotions, vouchers, discount codes, meal deals, loyalty rewards, free items, or other offers from time to time.

Promotions are subject to the specific terms displayed with the offer. These may include validity dates, branch exclusions, minimum spend, item exclusions, collection or delivery restrictions, single use limits, customer limits, and other conditions.

Unless stated otherwise, promotions cannot be combined with other offers, exchanged for cash, transferred, sold, or applied retrospectively to previous orders.

We may withdraw, amend, suspend, or refuse a promotion where there is a technical error, pricing error, misuse, suspected fraud, breach of terms, or operational reason.
 

14. Gift Cards and Store Credit

Gift cards, store credit, and digital vouchers are subject to any additional terms displayed at purchase or issue.

Gift cards and store credit have no cash value and may be used only through the channels stated at issue.

Lost, stolen, expired, or unauthorised gift cards may not be replaced unless required by law or agreed by us.
 

15. Musashi Loyalty Programme

The Musashi Loyalty Programme is available to eligible customers who create a Musashi account and participate according to these Terms and any additional loyalty rules displayed on our website or app.

Loyalty points may be earned through eligible purchases or promotional activities. The rate at which points are earned, the items eligible for points, and the rewards available may change from time to time.

Points are credited to the account used to place the eligible order. Points are personal to the account holder and cannot be transferred, sold, exchanged for cash, or combined across multiple accounts unless we expressly allow it.

Points may be excluded for free items, refunded items, cancelled orders, delivery charges, service charges, discounts, vouchers, redeemed rewards, alcohol, or other items that we specify.

Points may expire after a stated period. The current expiry rules and points balance may be displayed in your account.

We may refuse, remove, adjust, or cancel points where we reasonably believe there has been error, fraud, abuse, misuse, duplicate accounts, breach of terms, or returned or cancelled transactions.

We may change, suspend, replace, or end the Musashi Loyalty Programme. Where practical, we will publish changes on our website or app.
 

16. Marketing and Customer Communications

We may contact you about your orders, account, delivery, collection, loyalty programme, service messages, security messages, and customer support.

Where permitted by law, we may send marketing communications about similar Musashi products, promotions, offers, or services. You may opt out of marketing communications at any time by using the unsubscribe link in our emails, changing your marketing preferences where available.

Service communications related to an order, account, payment, delivery, collection, safety issue, or legal notice may still be sent where needed.
 

17. Privacy and Cookies

We process personal data in accordance with our Privacy Policy and Cookie Policy.

Our Privacy Policy explains what personal data we collect, why we use it, how long we keep it, who we share it with, and what rights you have under applicable data protection law.

Our Cookie Policy explains how cookies and similar technologies are used on our website and app.
 

18. Intellectual Property

All content on our website and app, including text, images, logos, trademarks, trade names, menu descriptions, graphics, icons, layout, software, and design, belongs to Musashi or our licensors.

You may use our website and app for personal browsing and ordering. You may print or save extracts for personal reference.

You may not copy, reproduce, modify, distribute, scrape, commercially exploit, use our trademarks, or create derivative works from our website, app, menu, images, or other content without our prior written permission.
 

19. Acceptable Use

You agree to use our website, app, ordering system, account system, and loyalty programme lawfully and responsibly.

You must not:

  1. misuse the website, app, or ordering system;

  2. attempt to gain unauthorised access to our systems;

  3. introduce viruses, malware, bots, scraping tools, or harmful code;

  4. interfere with website or app operation;

  5. use false, misleading, or unauthorised account information;

  6. abuse promotions, vouchers, loyalty points, refunds, or chargebacks;

  7. harass, threaten, abuse, or discriminate against staff, drivers, customers, or other users;

  8. use our content or ordering system for unauthorised commercial resale.

We may suspend access, cancel orders, close accounts, remove points, or take further action where we reasonably believe this section has been breached.
 

20. Third Party Platforms and Links

Our food may be available through third party platforms such as delivery marketplaces, booking platforms, payment providers, maps, social media platforms, or other digital services.

Where you order through a third party platform, that platform’s own terms, fees, refund processes, account rules, privacy terms, and customer support procedures may also apply.

Our website or app may contain links to third party websites. These links are provided for convenience. We are responsible only for content and services that we control.
 

21. Our Liability

We are responsible for losses that are a foreseeable result of our breach of these Terms or our negligence, subject to the limits set out in this section and applicable law.

To the fullest extent permitted by law, our liability for an order is limited to the price paid for the relevant order.

We are not responsible for business losses, loss of profit, loss of revenue, loss of goodwill, loss of opportunity, loss of data, indirect loss, or consequential loss arising from use of our website, app, ordering system, or products.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that cannot legally be limited or excluded.

Your statutory rights as a consumer remain unaffected.
 

22. Events Outside Our Reasonable Control

We are not responsible for failure or delay caused by events outside our reasonable control.

Such events may include severe weather, traffic disruption, road closures, power outage, internet or telecommunications failure, fire, flood, epidemic, public health restrictions, supplier failure, labour shortages, strikes, civil disturbance, government action, technical failure, or other events that reasonably affect our ability to operate.

Where such an event affects your order, we will try to contact you and provide a reasonable update or solution.
 

23. Changes to These Terms

We may update these Terms from time to time.

The Terms in force at the time you place your order will apply to that order unless a change is required by law or public authority.

Updated Terms will be posted on our website. Continued use of our website, app, account, loyalty programme, or ordering service after updated Terms are posted means you accept the updated Terms.
 

24. Severability

If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue to apply.
 

25. Transfer of Rights

We may transfer our rights and obligations under these Terms to another organisation, provided this does not affect your legal rights.

You may transfer your rights or obligations under these Terms only with our written agreement.
 

26. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland.

You may bring legal proceedings in respect of these Terms, our website, app, ordering services, or products in the Irish courts.
